    Dear Kyle,
    I have been fighting with Wells Fargo/ASC doing a loan modification for 11 months. The actual investor CSMC PMSR told my attorney Triton Law Group on 11/30/2011 that I cannot assume the loan unless my ex-wife was dead, truly in the customer reply contact notes in their computor. I was always trying to do a loan modification. During my divorce over three years ago, my ex-wife signed over on the divorce degree with a filed quick claim deed transfer into my name only. My situation is that I am 19 months behind in payments, I am the only one on title, my ex-wife is on the note, I was never put on the note from the start because my credit was not good. At the start of buying our home I had the quaifying income to get our interest only loan in August 18, 2005.The bank in loss mitigation said no problem Mr. Banyar we will get you a loan mod (after 11 months of implementing the process). In the end the bank served a letter of default to me at my home on May 2, 2011 (but papers had ex-wife’s name on default notice not mine) even though I am on title and she is not. The bank filed the first sale date (or my ex-wife’s) on August 31, that was postponed to September 30, 2011, then, October 31, then November 30, and now to December 30. Right now I and my attorney called Wells Fargo/ASC to get the news from the investor and an update to our case. Now the new sale date looms. What is our next move kyle, we need help and need your service before the foreclosure date. First the divorce, then work slowed down, then I took care of my mother whom passed away 01/20/10 with her modalities. At that point paying bills, Moms debt and everything else I fell behind. Again remember this has only affected my ex-wifes credit and not mine. I have since then remarried, very happy but we want to fight sale date and foreclosure because this is our dream home. The bank has lied to us and never lived up to the promise that they led us to believe as it was said to us over and over in countless discussions on the phone that my NOT being on the note, but only on a recorded title deed was completely workable and no problem.     I have a slightly different (kind of complicated) story than most folks. In 2007, I lost my home in North Carolina to foreclosure. I had already moved to California so I let it go. (The tenant didn’t pay rent, I couldn’t pay the mortgage AND the rent I was paying in California). So, I’m working as a writer and everything seems ok, then THIS RENTAL house goes into foreclosure, the owner walks away in June 2009. (There was supposed to be an auction but it never happened.) The bank and the owner walked away from this house for 2 1/2 years. In the meantime, I’m doing all the repairs on the house, I even had to fix a leaky roof (I did a great job but I’ll never do that again). The plus side, is, we stopped paying the rent, thinking the bank was going to foreclose every month. The owner made only one feeble attempt to kick us out and that was it. (There are some serious plumbing problems with the house that he didn’t want to fix). The house is seriously underwater. The loan balance is something over $800,000.00. So, I was entertaining waiting it out to do a Complaint for Adverse Possession (another 2 1/2 years from now.) The bank canceled the foreclosure about 6 months ago and I didn’t know what to make of it. Now, I find out yesterday, the house is listed for short sale. Since the owner is not interested in fighting the foreclosure, will your system help me fight this thing. BTW, it’s a MERS thing, which is why I think they’re not trying to do a regular foreclosure. Please let me know your thoughts on this. Thanks. I’m very interested in purchasing your system, but I want to make sure it’s the right thing for me.

I do think that you are on the right track with adverse possession though. I would also check CA code to see which laws protect you as a tenant in a situation such as yours.

    Your situation is not as uncommon or complicated as you might think.1. Since MERs is involved, you could end up with the house. Mers has struck out on so many fronts. You need to read this “Deposition of William C. Hultman, Secretary and Treasurer of MERSCORP” (170pages), located here; http://stopforeclosurefraud.com/2010/08/27/exclusive-mers-deposition-of-secretary-and-treasurer-of-merscorp-42010/ 2. Your making repairs GIVES YOU capacity as a real party in interest.3. Odds are high that you are more entitled than the guy being foreclosed on, because you have a vested interest in the home because of the repairs.You could have ended up with the home you left behind also.

    I have received a letter from the Atty of GMAC my lender stating that my house will be foreclosed on and if I wanted to rent my house temporary that I needed to sigh the FHA document allowing me to stay in my house to rent it. My house has received a short sale on the property and GMAC has received the offer from the buyer but has not signed off on the offer. GMAC is not the first Lien holder on the property, I am the first Lien holder on the property because of a Lien that I had file against the Builder on this Property and a clean Title was never given to me and shows GMAC as the second Lien holder. I need your help in filing the proper documents that will prevent a foreclosure on my home. My Mortgage was transferred to GMAC by another company which is not seen on my Title. I need the proper format of the filing so that I may file it in court. I did not have the funds to pay for an Attorney and many of the Attorneys that I had spoken too, did not know how to go about in filing a wrongful foreclosure. Can you help me?

    If a loan modification agreement (interest only) was signed, but no other documentation was provided, was the loan modification done correctly? The servicer is IndyMac and the lender was MLN. I’m asking as I don’t know whether your information/program will do me any good at this point. Thank you.

      Well, if you signed a loan modification agreement with a pretender lender someone claiming to own your mortgage note that authority is questionable. Anyone could prepare a loan modification and have you sign it. However, that lender would need to also be a Holder In Due Course and acquired the authority to grant you a loan modification. Every homeowner in America should research to find out if their mortgage lender is really a true holder.

    From my understanding once a quite title is filed still remaining is the promissary note to pay. I am considering your program and have done extensive research on this subject and my home. I have contacted my assesor and no title change has ever been filled. I started with Resame Mortgage they filed bankruptcy in 2005.From my understanding sold out to Lehman Bros whomfiled bankruptcy in 2007.J.P. Morgan Chase is the “servicer” .Lehamn Bro filed lawsuite against Chase and won now Chase has filed an appleal. When I ask to produce the note it has gone unanswered upon talking with a depbt colllecter I was told my note is a “ward of the courts” not sure what this actually means. Can your program help me and what is the risk or guarnetee of ligitamacy. I have talked with many person whom were con artist so now a little scared to purchase.

      No legal advice… Generally, what happens when lenders file for Bankruptcy assets are under receivership and the courts control sales of property, transfers, etc. Most likely your property is a ward of the court to protect it from being stolen. What we have seen is that many lenders often assign property without court approval when in Bankruptcy. Often times when the originating lender is no longer even in business. It takes learning the right knowledge how-to detect wrongful foreclosures. We encourage anyone who is interested in the Go Fight Foreclosure System to do their due diligence to find the best products and resources they need. The information provided is valuable information about the mortgage process, foreclosure, case studies, tips, sample forms, etc to help fight foreclosure. However, no one can promise you anything fighting foreclosure is hard work. It will involve effort to research and learn.     This is not about the “title to the house” it’s about lender liens against the house. You can always convey title however if you can’t provide a release of lien (reconveyance) to the buyer, they can’t have their bank place their lien and if the new lender can’t do that, no loan, no closing. The title (better known as the deed) to the property is not the lien (usually from a mortgage). Although some of the facts were correct, making people think their mortgage is the same as the title is wrong. People, call a Realtor, a loan professional, or an escrow or title officer at a title company. They can explain your reality. Then if necessary, you can go to a lawyer who can help. If you’re at this point, you likely have money from the bank rejecting your payments. Use them on a lawyer for a consult and help filing papers to make the bank produce proof they own the note (lien) against your property.

    I bought your system, and loved it dearly, but when we went before the judge she dismissed anything we had to say and awarded summary judgment to the fraudulent plaintiff and attorney group. PHH Mortgage and Lerner, Sampson and Rothfuss. Can your Quiet Title Audit still help? I plan on appealing the decision and order, b ecause I know the judge did not read any of the pleadings, answers or responses we presented. I have thirty days to appeal the decision here in Kentucky. Kentucky seems to be so far behind in this fraudulent foreclosure. Just continue the good ole boy system. Your help would be greatly appreciated.

    Do you offer in this course the templates, and information to file a TRO temporary restraining order or injuction to stop a foreclosure sale? Or do I need a lawyer to be able to stop a foreclosure sale? I am not clear on this? thank you

    HELLO, I recieved a permanent modified loan from Bank of America effective 2/2009. they never set me my permananet modified papers until March 4, 2011. I never missed a payment. I got the modified loan because NACA advised me tha I had been given a predatory loan. I paid pursuant to the permananet modified agreement and all of a sudden in the middle of March 2011 I received a notice of default. they would not accept my checks forcing me into a default. I wasn’t in a default status in March July 20, I was told my home was sold to Inflection Point LL.What the heck!!! I had a securitization completed and the person who approved the foreclosure, worked for Bank of America, The trust company and a few others. The dates are suspect. Robo signing is evident. How do I stay in my home and fight for wrongful foreclosure, get the foreclosure off my credit and now fight the company who now hols the deed. I am stressed out. Never ever missed a payment. I even kept sending the payments to Bof A. July was sent back to me as well. This is crime at it’s best and I do plan to sue Bof A.

    In wa. non judicial state what method does your program use to let meaddress standing besides filing a suit against them? If bankruptcy, Ch 7, or 13? When to file? Do you have documents for this?

    My home went into default and elevated to foreclosure. I believe that the foreclosure was wrongful. I attempted to contest the forclosure through legalaid but was told bankruptcy was the only recourse. After attempting to file I was told there wasn’t enough time and advised to move. I did so in November of 2009. I know now that I received poor advice. The home has not been sold as of today’s date. What can I do now…

      Thanks for taking the time to stop by our site to leave a comment. I am sorry to hear that you were misinformed about your foreclosure prevention options. Your best option right now is to determine if there was improper mortgage securitization in reference to your mortgage note. If this is the case your mortgage lender is not a Holder In Due Course and therefore has no authority to foreclose on your home.
