    This will keep you busy for a while … with conspiracy theories if nothing else. :) You might pass this information along to the contact you made through the Notre Dame lady to see what they say about whether these discrepancies can buy you time or negotiating power.

    The documents attached to your foreclosure complaint include a copy of your note and mortgage, as well as a copy of an assignment of the mortgage from Countrywide to BAC Home Loans Servicing and an “allonge” that transferred the note from Countrywide to BAC Home Loans Servicing. [An "allonge" is essentially like endorsing a check made out to you over to someone else. It's only supposed to appear on a separate sheet of paper if there isn't room for an endorsement on the note itself, which there isn't.]

    The mortgage assignment is dated July 22, 2010, and is signed by Laura Pirritano and Kaneisha Hunley as Assistant Vice Presidents of Countrywide. But, both women are listed as officers of Bank of America in unrelated court documents as early as January 2010 in North Carolina and March 2010 in Massachusetts. Laura Pirritano is actually named as a manager of an LLC wholly owned by Bank of America in 2001. She signed a document in 2007 saying that she was an AVP at Bank of America. She signed another document six days after she signed yours saying that she was an Assistant Vice President for BAC Home Loans.

    The allonge is dated June 17, 2010, and is signed by Roxanne Nowicki as Assistant Vice President of Countrywide. She is also listed as an officer of Bank of America in the same North Carolina and Massachusetts court documents. Of more interest with Roxanne is that I found a couple of earlier documents with her signature (and her notary stamp) and they just don’t appear to be the same as the signature on your document (which is not notarized or witnessed at all). Five days after she signed your allonge as AVP of Countrywide, she signed another document as AVP of MERS.

    All of this is fixable by Bank of America by getting proper signatures in place, or by having these three people swear out affidavits that they did, in fact, sign the documents. But they should have to fix those problems before they can move forward with the foreclosure.

    Also, the assignment and allonge indicate that Countrywide didn’t transfer your mortgage/note to BAC Home Loans until June/July of 2010. But, the mortgage statements that I have in your paperwork show that BAC was managing your loan at least as early as May of 2010. From your credit report, it looks like they’ve had it for much longer.

      Hi Alex

      What works best is to visit the county courthouse and enter her name. This will give you an idea of like and similar security instrument transfers that Ms. Pirritano have signed. Generally, you will find that she may have also signed for different conflicting banks.
